By participating in the Aloha Marine SWFL SPYDER FX16 Boat Giveaway (the “Giveaway”), each entrant agrees to be bound by these Official Rules.

1. SPONSOR: The Giveaway is sponsored by Aloha Marine SWFL (“Aloha” or “Sponsor”).
2. ELIGIBILITY: The Giveaway is open to legal residents of the United States who are at least eighteen (18) years of age at the time of entry, except where prohibited or restricted by applicable law. Employees, owners, officers, directors, agents, representatives, and immediate family or household members of Aloha Marine SWFL and its participating partners are not eligible to participate or win. Aloha reserves the right to verify eligibility and require valid identification or other documentation reasonably necessary to confirm an entrant’s eligibility.
3. HAPPY HOUR: Aloha Marine SWFL will host a private Happy Hour in connection with the Giveaway at the Fort Myers Boat Show on November 15, 2026, from 2:30 PM until 3:30 PM. The Happy Hour ticket price is $25 per person. A valid Happy Hour ticket is required for admission to the private Happy Hour. The Happy Hour will include beer, wine, and soft drinks while supplies last. No food service is included or offered as part of the Happy Hour. The Happy Hour admission fee is for access to the private Happy Hour and its beverage offerings and is not a purchase of a chance to win a prize. Alcoholic beverages will be served only to persons who are legally permitted to consume alcohol under applicable law. Aloha reserves the right to require valid government-issued identification and to refuse alcohol service to any person for any lawful reason, including suspected intoxication or violation of applicable law. Aloha may refuse admission or remove any person whose conduct is unsafe, disruptive, threatening, unlawful, or otherwise inappropriate. No refund will be required for a person removed or refused admission due to such conduct, except where otherwise required by law.
4. GIVEAWAY ENTRY: No purchase or payment is necessary to enter or win the Giveaway. Aloha will provide a free method of entry as specified in the official Giveaway entry instructions. A person does not need to purchase a product or service from Aloha to enter or win. A Happy Hour ticket provides admission to the private Happy Hour but does not constitute a purchase of a chance to win. Each eligible entrant may submit only the number of entries permitted under the applicable entry instructions. Entries received through unauthorized methods, or entries that are incomplete, inaccurate, altered, duplicated, or submitted in violation of these Official Rules, may be disqualified.
5. EVENT LOCATION AND GIVEAWAY DRAWING: The Happy Hour and Giveaway drawing are scheduled to take place at: Happy Hour from 2:30 PM to 3:30 PM, Fort Myers Boat Show, Historic Downtown Fort Myers Riverfront, Fort Myers, Florida on November 15, 2026. The Giveaway drawing is scheduled to take place during the Happy Hour, on or about 3:00 PM. The drawing time may be adjusted by Aloha for operational, safety, venue, weather, or other circumstances, provided the Giveaway is conducted in accordance with applicable law and these Official Rules. Attendance at the Happy Hour is not required to enter or win unless otherwise required by applicable law or expressly stated in the applicable free-entry instructions.
6. PRIZES:
   Grand Prize: One (1) eligible winner will receive: One (1) SPYDER FX16 boat. Approximate Retail Value (“ARV”): $32,000.
   Additional Giveaway Prizes: Additional eligible winners may receive prizes that may include: Fishing poles, Aloha Marine SWFL apparel, Hats, Gear packs, Other promotional merchandise or prizes announced by Aloha. The number, type, and ARV of additional prizes will be disclosed in the Giveaway materials or at the event. Prizes are awarded as described in these Official Rules and are subject to applicable manufacturer terms and warranties. The boat winner is solely responsible for any costs and expenses not specifically included as part of the prize, including applicable federal, state, and local taxes; title and registration fees; insurance; transportation; fuel; maintenance; storage; launching; docking; accessories; financing; and other costs associated with accepting, owning, registering, maintaining, or operating the boat. The prize is not redeemable for cash and may not be transferred or assigned, except where required by applicable law. Aloha reserves the right to substitute a prize with another prize of equal or greater value if the advertised prize becomes unavailable for reasons beyond Aloha’s reasonable control.
7. WINNER SELECTION AND ODDS: Potential winners will be selected by random drawing from among all eligible entries received through the authorized entry methods. The Grand Prize drawing is scheduled to occur on or about November 15, 2026, at approximately 3:00 PM, during the Aloha Marine SWFL Happy Hour at the Fort Myers Boat Show from 2:30 PM to 3:30 PM. The odds of winning depend upon the total number of eligible entries received. Aloha does not guarantee that any particular number of entries will be received.
8. WINNER NOTIFICATION: Potential winners will be contacted using the contact information provided at the time of entry. A potential winner may be required to provide valid identification and proof of eligibility and may be required to complete and return an affidavit of eligibility, liability release, and publicity release, where permitted by law. If a potential winner cannot be contacted, fails to respond within seven (7) days, is determined to be ineligible, declines the prize, or fails to comply with these Official Rules, Aloha may select an alternate potential winner from the remaining eligible entries.
9. TAXES AND PRIZE EXPENSES: The winner of the boat is solely responsible for all applicable federal, state, and local taxes and all other costs associated with accepting, registering, insuring, transporting, owning, maintaining, or operating the prize. Aloha may report the value of the prize to the appropriate taxing authorities and issue any tax documentation required by law.
10. LIABILITY AND RELEASE: Participation in the Giveaway and attendance at the Happy Hour are voluntary. To the fullest extent permitted by applicable law, each participant assumes responsibility for risks associated with participation in the Giveaway, attendance at the Happy Hour, consumption of alcoholic beverages, and acceptance or use of any prize. Participants are responsible for their own conduct and for complying with all applicable laws, rules, regulations, venue requirements, and safety requirements. Aloha is not responsible for injuries, losses, damages, delays, interruptions, theft, or other claims arising from or related to participation in the Giveaway, attendance at the Happy Hour, or use of any prize, except to the extent such liability cannot legally be excluded or limited. The boat winner is solely responsible for the safe operation, registration, insurance, maintenance, storage, transportation, and lawful use of the boat. Aloha is not responsible for any manufacturer defect, mechanical failure, warranty claim, or other issue relating to the boat or any other prize. Any applicable manufacturer warranties will be governed by the applicable manufacturer's terms. Nothing in these Official Rules is intended to waive or limit any liability that cannot legally be waived or limited.
11. DISQUALIFICATION: Aloha may disqualify any entrant who: Provides false, inaccurate, or misleading information; Attempts to enter through unauthorized means; Submits entries in excess of the permitted limit; Tampers with the entry process; Uses automated systems, bots, scripts, or other prohibited technology; Attempts to interfere with the fairness, security, or operation of the Giveaway; Violates these Official Rules or applicable law; or Engages in fraudulent, abusive, threatening, unsafe, or disruptive conduct.
12. MODIFICATION, SUSPENSION, OR TERMINATION: To the extent permitted by law, Aloha reserves the right to modify, suspend, postpone, or terminate the Giveaway if circumstances beyond Aloha’s reasonable control affect the security, fairness, integrity, or proper operation of the Giveaway. Such circumstances may include severe weather, natural disasters, technical failures, fraud, unauthorized interference, venue issues, safety concerns, governmental restrictions, or other unforeseen circumstances.
13. PRIVACY: Information collected in connection with the Giveaway will be handled in accordance with Aloha Marine SWFL’s applicable Privacy Policy.
14. GOVERNING LAW: These Official Rules are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except to the extent otherwise required by applicable law. Any dispute relating to the Giveaway shall be handled in accordance with applicable Florida law and in a court of competent jurisdiction in Florida, to the extent permitted by law.
15. GENERAL: If any provision of these Official Rules is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law. Aloha’s failure to enforce any provision does not constitute a waiver of that provision. These Official Rules constitute the complete terms governing the Giveaway and supersede any inconsistent prior descriptions or representations concerning the Giveaway.
